A Research On Personal Information Protection In Government Information Openness

The implementation of The Decree of Government Information Openness signifies that the government information openness advances to a new stage. However, personal information protection in government information openness should also not be neglected. This article probes into this problem mainly from three aspects.Chapter1--the personal information in government information openness--introduces the theories, chiefly about the theories of government information openness, the theories of personal information, the theories and principles of personal information protection in government information openness. Through the study of those theories, the importance of the personal information protection in government information openness will become definitely explicit.Chapter2concerns that because of the generality of the regulations about personal information protection, the ambiguity of government tort liability, the lack of the appropriate regulation enacted by appropriate supervisory agency in our existent laws, personal information in government information openness takes place frequently. Besides, in this chapter, in order to lay a solid foundation to personal information, several cases are applied to analyze the core types of infringement of personal information in terms of the three stages of government information openness, that is, collection, storage and issuance.Chapter3puts forward some complete proposals to the current personal information protection in government information openness, mainly from the aspect of legislation and enforcement, especially focuses on the tort forms of sensitive personal information and general personal information published personal information and unpublished personal information, public figure’s personal information and non-public figure’s personal information in the collection, storage and issuance of information.
