Due to the improvement in the construction of democracy and the rule of law, China’s guarantee of civil rights is more comprehensive, government is playing a more critical role in national booming economy; meanwhile government’s power has greatly influenced people’s daily life and become ubiquitous in our sociality. As a result, there is a fierce collision between the execution of government power and civil rights protection. Administrative compensation system is of great importance in balancing two parties’interests, especially when the execution infringes the individual rights of citizens but in the name of public interests.Every year many violence and mass incidents are stimulated from place to place because of land expropriation, housing demolition, etc. All these demonstrate the deficiency of administrative compensation system security and also indicate that the current executive compensation system is seriously flawed and inadequate. The system can not effectively protect citizens’legitimate rights and interests now. Therefore, improving and perfecting the administration compensation system has become an important task before us. China’s administrative compensation system will be discoursed and researched in the following four parts in this paper.Overview of administrative compensation will be focused in the first part, and there are four sections. In section I the concept of executive compensation was defined through the analysis of several representative academic views. According to the definition of executive compensation, elements of executive compensation were introduced in section II. In section In section III the nature of administrative compensation was identified. Section IV provides a brief description of the important role of the administrative compensation.The second part focuses on the compensation system. The first section introduces several basic theories of administrative compensation. In Section II, historical development of French, German, Japanese administrative compensation system was introduced together with other countries’. Section III collates and summarizes the historical development of China’s administrative compensation system.The third part, including six sections, is a reflect the current administrative compensation system of China. Defects and deficiencies can be seen in china administrative compensation system such as the principle of administrative compensation, the definition of public interest, the range of administrative compensation, standards, procedures and channels for relief.The fourth part is the focal point of this article which presents suggestions to perfect the current administrative compensation system. Six sections show six aspects concerning defects and deficiencies of the current administrative compensation system, and better ideas are proposed.
