Governance Of Soft Law：the Path Choice Of Harmonious Administration

In recent years, the soft law research in our country has just been unfolding, and becomea research focus of law, administrative management etc. Although the current academiccircles of soft law defined yet to reach a consensus, that we can not deny the influence of softlaw has penetrated into every field of society. Soft law was put forward as an oppositeconcept with hard law, In spite of soft law in the government administration is prevalent, thensoft law and its rule has not been given sufficient attention. Compared to past governmentadministration, the legislative process and the lack of the public to participate in an active andorderly and people will express and fully communicate with people, the administrativeprocess over-reliance on enforcement and punishment of such unilateral administrative way,While the soft law in legislation and administration of the entire process of attention less force,more consultation, higher fair features, more suitable for the development of modern societyand the modern government administration mode and development orientation ofrequirements.Along with the deepening of reform and opening-up and the socialist market economicsystem ceaseless and perfect, CCP’s fourth generation of collective leadership to the scientificoutlook on development as the guidance, advancing the construction of socialist harmonioussociety, corresponding correcting governmental administration concept, change the ways ofgovernmental administration, and properly solve the non harmonious problem in governmentadministration, give full play to the government in the construction of socialist harmonioussociety in the process of positive role, has become the research focus for government and thetheoretical.Soft law with its unique consultative democracy, justice and promoting orderlyparticipation of the harmonious development of the society and adapt to the moderngovernment administration mode and development orientation of requirements, playing animportant role in our efforts to build a harmonious administrative pattern.
