Since the reform and opening up30years ago, our country’s medical technology has improved a lot. Many incurable diseases in the past have been successfully healed. With so many medical achievements, we should feel satisfied, but the reality is that the development of medical science also has brought in some new problems. Among them, the problem of the excessive medical care is becoming more and more serious, which makes the escalation of the conflict between the doctor and the patient, and seriously influences China’s social stability and harmony. The scholars and experts of different subjects have put forward a lot of useful advice on the solution of the excessive medical problem, but scholars in law still have paid little attention on this problem. And as for the law making of regulating excessive medical behaviors, there are few achievements. In the light of this reality, the author makes an analysis on the cause of the excessive medical treatment, combines previous research and puts forward the plan of regulating the excessive health care from the angle of law.The whole thesis consists of the introduction, the text of four chapters and the conclusion. The introduction explains the reasons and significance of choosing this subject and the research achievements in China. The second chapter discusses the present situation of excessive medical problems, and points out various forms of the excessive medical care and its harm. The third chapter analyzes the cause of the excessive medical care and draws a conclusion of subjective and objective reasons. The fourth chapter gives a research into the law theory related to the regulation of excessive medical care, and analyzes the legal nature of the excessive medical care. Combining the previous research, the last chapter puts forward the plan of regulating the excessive health care from the perspective of prevention and punishment. The final part is the conclusion of the whole research in this thesis.
