Internet of things (IOT) set off the third wave as the world’s information industry. Just in ten years, the indistinct concept of the IOT has developed into the clear industrial application, reflecting its unlimited potential for development. Intellectual property undoubtedly play a very irreplaceable role in guidance and protection of IOT. The world has played more attention to impetus to the economy of IOT, and has risen it to the national strategic level. All countries are particularly focus on the formulation of intellectual property related laws in the legal level, and the improvement of the legal environment of the IOT applications. China is no exception. China has deep influence in the origin of IOT, and actively explores its own IOT development model. Under the current IOT development model which called "policy assisted and the pilot first", China has gradually recognized the two application bottlenecks:the core technology of intellectual property rights conflict with the standardization, and Business methods can be patented conflict with international trends. These two issues will be destined to exist a long time depends on specific national conditions of China, development status of China and cultural background of China. We shall find a breakthrough in technical aspects, legal aspects, and the industry chain fields. The government shall play the triple role of the general direction of policy-making in the industry, the guide of specific needs to the market, the intellectual property about the aspects of legislative, justice, law enforcement, avoiding monopoly or breed for abusing of power; Industry Association is committed to a more professional, diversity and substantial service to provide a more specific way for the protection of intellectual property;The enterprise shall recognize their own strengths and weaknesses, strengthen the contacts of upstream and downstream industry and learn from each other, consolidate their fundamental intellectual property core competitiveness. We must strengthen the government, industry associations, business tripartite synergy in order to make further development of IOT in China.
