Sacrifice is an important activity in ancient Chinese society, has played a pivotalrole both in people’s lives and in the monarch’s rule, also is the traditional Chineseculture unique content. Mostly academic circles for the studies focus on the history ofancient Chinese sacrifical system or the Angle of folklore, the research from theperspective of jurisprudence is still rare. This article attempts to study the analysissystem of sacrifice from the ritual and law two aspects, to the last feudal dynasty,Qing dynasty in ancient Chinese society as the research background, in order to setthe ancient country of etiquette and the national law in standard of Qing DynastyEtiquette and Qing Dynasty Statutes as the research object, focuses on discussion andargument the scarifical system of regulation in the rites and law of the ancientChinese society. Article is divided into four parts as a whole.The first part is sacrificial system overview. The contents are such as the originof the sacrifice. About the origin of sacrifice system has a variety of, which origin oftheory has its rationality, and due to the lack of historical data that it doesn’t have acertain origin of the sacrifice. But no matter what sacrifice origin, it contains the maincontent, such as ritual objects, scale, basically do not have big changes in the form ofregulations.The second part is Rites of sacrifical system specification. Mainly useingQing Dynasty Statutes as the research object to analyze the protection for thesacrifical system. Article through the analysis of Qing Dynasty Etiquette to study thespecific regulation of sacrifice, in view of Qing Dynasty Etiquette of sacrifice sort isvarious, so this part is mainly based on scale as an overall classification, large-scaleritual, size of sacrifice, small sacrifice classification in both lists is morerepresentative of ritual activities, to analyze the detailed regulation of sacrifice. Againat the end of this section, with the help of Qing Shi Gao ritual activities carried out onsome of the details, further refinement of Qing Dynasty Etiquette to sacrifical systemof regulation.The third part is the method of sacrificial system of protection. Mainly useing Qing Dynasty Statutes as the research object to analysis the protection ofsacrifical system. Qing Dynasty Statutes and Qing Dynasty Etiquette are different; itis a negative approach to regulation of sacrifice. In Qing Dynasty Statutes, nearly22law of the article related to the sacrificial system, article22of this law, to sacrificesystem of different aspects of regulation. Including used in violation of the sacrificialand other objects, in violation of the sacrifice etiquette, in violation of the site andother violations of ritual activities. Also on Qing Dynasty Statute, the mainresponsibility for violation of the law text content according to the study onclassification protection. In addition, the article also will be analyzed ethically, Tangdynasty famous code relevant to sacrifice regulation compared with Qing DynastyStatutes, to analyze about the regulation form of sacrifical system and the sentencingrange.The fourth part is Sacrifice, the method of comprehensive analysis andevaluation through the law system and the rite systerm. Through Qing DynastyEtiquette and Qing Dynasty Statutes in the comparative analysis of the system ofsacrifice, to clear the method of protection, but also made clear the ritual and lawalthough the sacrificial system in different ways, but the essence is consistent with thepurpose. Finally to sacrifice the affirmative appraise the role of the system, has beenclear about the sacrificial system not only plays an important role in the ancientsociety, but also cannot be ignored in modern society has a practical value. Alsoreveal the sacrificial system in thousands of years of human progress has more andmore important reasons rather than drowning.
