The basic principles are critical for the whole law system of criminal procedure, and any new acts of publishing, amending and implementing, are followed these values. All those institutions can be revealed in the trying to achieve balance between justice and efficiency, restrain the expansion of public rights. Actually, it is appropriate to say that the critical values of criminal procedure are in the state of dynamic changing, rather than being immobile. As a result of this, it is obvious to see that there were value choices in a particular period of time. These choices are exactly the way how the institutions work in the law system and in the reality.Guilty plea is a legal institution that developed after the entrance of modem society, which is used as a vital solution to the conflict between the cumulating cases and rare law resources. This institution developed from the negotiation theory and social contract theory, and takes the values of efficiency and saving costs as its core.In this paper, there are four chapters in whole.The first chapter is mainly about the concepts referring the Guilty Plea, and also bringing some key legal terms into this chapter to make sure the understanding of this institution is appropriate and comprehensive.The second chapter introduces the multiple laws and regulations in different countries, and makes points in those characteristic statutes. This chapter will give the reader a general knowledge about how the Guilty Plea works in the worldThe third chapter focuses on the necessity and possibility of acting the Law of Guilty Plea and how the domestic law system works when the accused plead guilty.The last chapter will figure out the disadvantages of the existing system and give some suggestions on how to make it works more efficient and just.
