Under The Administrative Law Of The Illegal Income

Illegal income usually means all the revenue including things and money gained by methods which violate the provisions of laws and regulations. In administrative law area, the concept of illegal income is applied in all kinds of administrative laws and regulations. For the shortage of theoretical study, the whole concepts of illegal income are not clearly understood, and the boundaries are not clearly defined. Therefore, the relevant law enforcement standard become disorderly, the administrative efficiency get low, and related rights and interests of the damaged are infringed. That bad phenomenon causes directly the consequence that the illegal income system could not be applicable effectively. The purpose of this paper is to discuss the definition, the characteristics, the legal characteristics, suitable type, specification and solution to the conflict by ways of case research, semantic analysis, empirical analysis and logic analysis. Finally, this paper is to put forward specific ideas in order to construct and perfect the basic theory of the illegal income.This paper is divided into five parts.The first part is a foreword. The research background and practical significance of the illegal income are briefly introduced.In Chapter1, the definition, the characteristics, the legal characteristics are studied.In Chapter2, apply for illegal income. In the basis of Chapter1, the applied types of illegal income and the relationship between tax and illegal income are discussed.In Chapter3, the provisions of current administrative laws and regulations about illegal income and existing problems are analyzed. Through the overview of the present situation legislation, this paper expounds the harm caused.In Chapter4, proposals for perfecting legislation system of illegal income are given.
