Concerning The Improvement Of The Legal System Of Internet Copyright Protection In China

The invention and the rapid development of Internet has brought people’s life novelty and convenience, and has brought the spread of knowledge a double-edged sword. On the one hand, it promotes the cultural exchange and social progress; On the other hand, it leads to the phenomenon of piracy. It is very difficult to protect network copyright. This problem is a commonly concerned issue in the world in the field of intellectual property, and it is a very important issue to China’s legislature practice and judicial practice. So far from our reform and opening up, China’s copyright legislation has advanced rapidly. We has developed a series of laws and regulations, only to catch up with the pace of the world, the pace of technological development. So far from the copyright law enacted, China has successively through dozen of related provisions, but it only involving a few of network copyright protection, it has not form a system, makes the use of technical measures.This thesis is written when the amendment of copyright law is attracting public discussions. Based on the angle of Baidu Library incident, this thesis employs a wide range of measures to arrive to the suggestions of possible innovation. This thesis is divided into four parts:The first part introduces the definition and feature of network copyright and the legal protection available in China. Then with the invoke of Baidu Library incident, flaws and incompetence is exposed.The second part analyses the parties’rights and obligations and go to depth to expose the flaws in the protection system of network copyright.The third part introduces the international protection of network copyright protection and points out possible lessons we should learn and study from them.The last part through introduction of advanced protection system from abroad, summarizes the flaws in the protection system of network copyright and set forth possible measures to address these problems.
