The interpretation of torture by this paper is based on a dualistic qualitative of objective historical phenomenon and individual subjective behavior, so the research perspective on torture by this paper is separated into three levels, namely the social phenomenon, system behavior and individual behavior.While the examination of torture as a social phenomenon refers to the social historical background of the flourish and decline of torture resulted from its support and opposition by the political, economic and cultural subsystem of the overall social system; the examination of torture as a system behavior refers to the direct determinant of the flourish and decline of torture caused by the structure of the criminal judicial system itself; and the examination of torture as an individual behavior refers to the behavioral factors in terms of motive, mentality and background of the law enforcer when he executes the brutal punishment. The emergence of anti-torture campaign in contemporary era is conforming to the objective historical law of the decline in torture, and by establishing a legal system to control the torture behaviors, its objective to eradicate torture will be ultimately achieved.
