Research In The Forest Right Transfer Under The Background Of The Collective Forest Right System Reform

Institutional barrier just like the unclear rights, absence of business entities and so on is the biggest obstacle to the constraints of forestry in China’s rapid economic development. To solve this problem and explore the potential of the forestry resources and promote the income of farmers, the government of Fujian Province took the lead in collective forest right system reform in2003. The problem of unclear property rights was worked out efficiently through this reform, the perspicuity of the forest property rights laid the foundation of carrying out the transfer for forest right.This paper is based on the introduction of the reform on the collective forest right system of Fujian Province, took Z village as an sample of study and used the theory of property rights and the market economy to analyze the different logic between the village committee and villagers in the process of forest property transfer, then took the experience of other cities and counties in Fujian Province in the management of forestry and forest rights transfer, and made a comprehensive analysis of the problems in the transfer of the transferor and the transferee, market and government regulation from the prospect of the main participant of forest rights transfer, and tried to propose some solutions to the problems in the end.In this paper, the author thought that the problems that exist in the transfer of forest tenure is not caused by forest property transfer itself but irregulations of the forest rights transfer or the faultiness of supporting reform of collective forest right system reform. Actually, promoting the transfer of the right of collective forest to achieve the scale of operation of the woodland and making owners to share the revenue reform is not in contradiction, and the key is how to carry a just and equitable distribution of the benefits of reform. The government must achieve the goal of growth in resources and income of farmers, good ecology and harmony of woodland only can it properly handle the relationship among the foresters, forestry major owners and government.
