Study On Requirment Of Trademark Use

With the development of economic, the number of registered trademarks in Chinaincrease rapidly,left a large of unused trademarks. Trademark law clearly provides therequirement of trademark use. Trademark use is an obligation which shall be genuinelyperformed, otherwise the registered trademarks can be revocated. However, it’s difficultto identify trademark use in judicial practice,because our existing laws and judicialpractice lack clear and uniform rules.In this paper, we focus on requirment of trademark use. By investigating andstudying on laws and judicial practice,we intent to form China’s rademark use standardsfor recognization. In the first chapter, we emphasize the trademark useobligation,including the meaning of use, theoretical basis of obligation and laws ofsome countries. Chapters II and III together discuss how to fulfill the obligations,notonly requirements of range, but also requirements of four features. The fourth chapterfurther states the legal consequences of violating use obligation,which is the revocationof substantive rights and the loss of procedural rights.
