Legal System Of China’s Food Safety

Food is the most basic material conditions for human being’s survival and development. With the development of scientific technology, the development of the·society and the improvement of people’s living standard, people require not only nutritionious, delicious food, but also need more safety and healthy food. The rapid development of economy and the involvement of high-tech factors production of food has caused great impact on the traditional food production and has changed traditional food production and marketing strategies. Food manufacturing and the storage of it has greatly increased. Ways of working capital has changed greatly, this requires new food safety laws system’s appearance under the new situation of food safety administration.But our country’s current food safety legal system has many problems, this paper aims to research China’s food safety problems mainly in the food safety laws field. China’s current food safety relevant law system has many defects, such as the lack of unity and harmony, the regulation and supervision of food safety law’s enforcement and regulatory rights is not clear etc. Some obviously cannot meet the demands of social development.There is a big gap between us and developed countries especially in the regulation of food safety laws.so to improve the food safety law system with Chinese characteristics, to guarantee the people’s physical and mental health,and to maintain social stability is of great importance in both theoretical and practical perspectives.This paper is mainly divided into four parts:the first part is the general discussion of the food safety and food legal system.It begins with what is food, and comes to food safety which is based on the requirement of food, finally prompts food safety laws system, explains the concept and requirements.The second part is the foreign food safety laws system’s present situation and their inspiration to China.Through the analysis of advanced food safety laws system in the United States, the European Union, Japan and other countries, concludes the related food safety system which is proper to our country, provides references for the development of China’s food safety laws absorbing foreign advanced experience. The third part is the current food safety laws system situation and existing problems, through food safety legislation of our country, specific legal system overview of the food safety field to find out the insufficiency and the gap, we find out the cause of the frequent food safety problems from the legal system,lay the foundation to solve the food safety problems from the legal areas. A relatively centralized and unified food safety regulatory system, and improve regulatory efficiency.The fourth patr is the core sections of this article. It contains suggestions to our country’s food safety laws system:the first is to improve the healthy food safety laws and legal system’s construction management. The second is to construct a unite food safety standard system, by constructing a system which gives priority to national standard, the industry standard, local standard of the unity of the coordination of the food safety standards system, make food safety management work do unified standard, scientific management; Third is to perfect the legal system for the supervision of food safety; the fourth is to establish a complete information disclosure system and to improve the information disclosure by establishing the system of public, let common people fully enjoy the right to be informed, strengthen the supervision of the department of law enforcement, so that you can be fair, just and open in the law enforcement, enhance the credibility of the government and maintain social stability; the fifth is to complete the relevant supporting system, through the information disclosure system, resource management system, food safety certification system and food industry association of the system construction, realizes "from the fields to the table" process which is to monitor the food production and consumption at different stages and insure its security, can effectively control illegal food behaviour. Through the given suggestions to make a contribution to improve our food safety laws system and protect Chinese food safety.
