The Latest Development Of The International Extradition System

Today’s society, rampant transnational crimes, the suspects fled abroad, often through a variety of ways to evade the law. In order to effectively curb this trend, the need is the cooperation of countries in the world. As the international community an important tool in combating transnational crime, extradition system has been established in most of the world. China is no exception. But as time goes by and the extensive development of international cooperation on extradition, extradition system, some of the problems our country has emerged and gradually become an obstacle to cooperation on extradition, it is necessary to perfect our system of extradition in order to better play its the role.In this paper, the basis of international criminal law on the extradition of a starting point for the study of theory, through the cooperation of foreign extradition extradition regime of China’s new development and analysis of the status, identify problems in our extradition system, to identify the shortcomings of China’s extradition legislation, put forward for further of improvement measures. This paper is divided into three parts, the first introduces the basics of international extradition system, describes the basic concepts of international extradition system, historical development and basic content. In the second part of the latest developments in international extradition system and prospects of the content made them out, is in the world, international extradition system in the forefront of development, the search for the latest developments in international extradition system, the results of the extradition system "treaty pre-ism," several major international extradition system principles and application of summary procedure done to analyze, as a Chinese extradition system developed to provide reference. In the third part of this article, I focus on two areas to expand the Analysis, the first Chinese extradition system is the basic content and the problems which made interpretation of what followed from extradition to China to perfect the system, this is this article focuses on the content of which, in this part, the author mainly from the six aspects of the Chinese system, the improvement of extradition law to make the concept of a view of this Chinese legal system for extradition can rise to a new level, making China’s extradition system more recognized countries in the world, has reached the world advanced and extradition system are consistent, and do not lose our own position, without prejudice to China’s national interests, so that in the future related to the practice of China’s international extradition extradition of criminals can be more smoothly to achieve the legislative purpose of extradition itself.
