Talk About The Minor’s Criminal Record Eradication System

The minor crime situation at present in our country is not optimistic, and the current system of punishment has failed to effectively prevent and curb juvenile delinquency. The criminal record system does have a positive significance in the prevention of juvenile delinquency, but the indefinite existence of the convictions recorded permanent negative impact to minors, which requires the limit and balance of the criminal record eradication system. At present, most countries in the world are actively promote criminal record eradication of this system, as a penalty to the follow-up, it has a good social performance, therefore, highly respected of our academia. Although China has no clear legislative provisions in this regard, in February2011by the Criminal Law Amendment (eight), exempts a minor part of the conditions the offender’s criminal record reporting obligations, this move means that China has already started in the minors criminal record Elimination System legislation. Therefore, effort to build a system of minor criminal record in line with our national conditions has important theoretical value and practical significance. This paper compares analysis of the provisions in the system in our country from the foreign legislation present situation, and points out the necessity and feasibility of the establishment of the system of criminal record destroy, and puts forward concrete construction scheme etc.
