Since the1990s, more and more exploration and attempt have been madethrough the way of village-retained-land for the resettlement of peasants whose landsare confiscated, and among them, the Village-retained-land Resettlement System inHangzhou is implemented according to local conditions, which not only has improvedsteadily, but also achieved good results in providing long-term and stable economicsecurity for landless peasants and promoting the remodeling process of “villageswithin the city”. Nevertheless, problems still inevitably exist during theimplementation of the corresponding system, such as inconsistence between previousand current policies, supporting system deficiencies, impractical requirements in someindividual regulations, and immaturity of oversight mechanism, etc. On the basis ofanalyzing the village-retained-land system in Hangzhou and combined with author’sown practice, this article makes system improvement recommendations for itsproblems. In addition to the introduction, this article intends to discuss the followingfive parts:The first part specifically addresses the concept of village-retained-land as well as the differences between the village-retained-land program and the project of houseswith limited property rights, and by means of the description of the concept andconnotation of village-retained-land and the contrastive analysis between the basiccharacteristics of the village-retained-land program and the project of houses withlimited property rights, the first part emphasizes the legality and compensatoryfeatures of the village-retained-land system while introducing the generalunderstanding towards the village-retained-land; The second part primarily starts withthe background, developing progress, system content and other aspects of thevillage-retained-land system in Hangzhou, sorts out its relevant regulations, andanalyzes and summarizes the system’s development and evolution progress and basicfeatures. The third part is the practical analysis to the village-retained-land system inHangzhou, in which it not only inductively analyzes the use patterns established bythe local government within the framework of Hangzhou’s village-retained-landsystem, but also comprehensively analyzes its use status through sizes, planningpurposes, construction and development modes and other aspects of thevillage-retained-land. The fourth part’s analysis centers on four aspects of problems inthe village-retained-land system in Hangzhou, which includes the poor connectionbetween the corresponding system and regulations, policies and the overall urbanplanning, the absence of supporting policies, excessively rigid for some of theprovisions, imperfection of the oversight mechanism, etc. The fifth part is theproblem-solving part. The author puts forward some suggestions for improvement asto the aforementioned four systematic deficiencies, the content of which includesperfecting the join between the village-retained-land system and regulations, policiesand the overall planning, improving sales registration system and other relatedsupporting policies, making adjustment to the provisions of land use restrictions andother rigid ones, and strengthening the supervision to the key aspects of project constructions like use of funds and to the core entity of collective constructionprojects.
