Procuratorate’s Supervision Of Civil Eforcement In Legal Vision

Chinese current judicial practice,“enforcement difficulty” and“enforcement disordered” problems have seriously hindered the process ofbuilding the rule of law,supervise the prosecution of one of the improtant deficienciesare one of the reasons why.Civilian implementation monitoring system with theprosecution can not be replaced by other system functions,and therefore our countryshould clearly defined that the implementation of supervision rights of the People’sProcuratorate,to build a comprehensive monitoring system of civil implementation ofthe prosecution.This article by the introduction,the main text and the concluding remark threeparts is composed,the main text divides into four chapters.The first chapter is civilexecution present situation analysis.In China,“enforcement difficulty” and“enforcement disordered” are the most major problems which exist in presentcivil implementation，the article introduce the main performance of “enforcementdifficulty” and “enforcement disordered”.In chapter two,the basis ofimprovement of the system of prosecutorial supervision is illustrated.In the future,thesystem-improving process is an inevitable trend both in legislation and praction,for ithas a very strong practical feasibility.In the third chapter,the current problem injudicial practice of the system is advanced.In the last chapter,the thesis gave somelegislative propasals at the existing problems of system of prosecutorial supervision ofcivil execution.Firstly,established the supervision of civil enforcement principles shoud be followed.Secondly,the scope of supervision defined,and then combined withthe scope of specific monitoring methods and program design. Finally, grant thecorresponding terms of the guarantee.The legislative proposals are very feasible andsignificant.
