Trademark licensing, is refer to the trademark registration person in the case of retentionof ownership, allowing other people to use its registered trademark in a certain deadline.Trademark licensing has become an important form of utilizing trademarks.In recent years, anumber of typical intellectual property cases, such as "Wahaha" and "Wang laoji" trademarklicense case, reflect the Trademark Law and relevant regulations of our country on TrademarkLicense filing system, and on how to avoid and resolve trademark license rights in conflictissues and how to balance both sides’ interests of trademark licensing, there is also designflaws and to be perfect. It also highlights the fact that companies need to reflect upon theirtrademark management policy and continue to strengthen the brand management andtrademark licensing strategy.Based on typical cases and issues it reflected,and in the existing theory on the basis ofstudies, according to author’s own thinking and research, this article use literature research,case studies, comparative analysis, empirical research methods and other research methods,try to put forward to improve our country’s trademark license filing system,and solve theproblem of the conflict of rights issues and allocation of interests of trademark licensingarising from it. And lead to further attention and study of the theoretical and practical circlesthe trademark licensing system, so as to continuously improve our trademark licensing legalsystem.This article is divided into six chapters: The first chapter is the introduction. Chapter II istrademark licensing case and its legal problems. Chapter III is filing legal issues of trademarklicense. Chapter IV is rights in conflict issues of trademark license. Chapter V is issues ofdistribution issues of benefits about trademark licenses. Chapter II draws out three trademarklicensing legal issues through illustrative cases, namely trademark license filing system issue,conflict rights issue and issue of allocation of interests of trademark licensing. The Third,Fourth and Fifth chapter is for the minute theory, through the theory elaboration and the caseanalysis, give the concrete perfect comments and the suggestions. Finally, the conclusion,reviews and summarizes the discussions and recommendations on the focus of this article,andexplains the subsequent issues need to continue to study.
