Human life can be a continuation of the guarantee of survival as thebasis for the protection of human health-a safe and healthy food. Thepremise of a country’s economic and social stability in food safety.At this stage, from the legal sense of the analysis, the followingperformance shows many of the problems of China’s food safety. Such asimperfections in the existing laws and regulations, the punishment is notenough structural defects in the regulatory system, food safety standardssystem is incomplete. Although the provisions of the Food Safety Act, thelaws and regulations alone can not solve all the problems in the field offood quality and safety. Punishment we need to build food safety, foodsafety law as the core legal system to deal with emerging food safetyincidents, while increasing the penalties for criminal behavior, increaseefficiency, and to explore new food safety regulatory approach, bycontinuously methods to improve food safety system and institution building, to narrow the gap between international standards.View of the food safety point of view, the author attempts to in-depthdiscussion and analysis of the legal system of China’s food safety, andstrive to put forward to improve the laws and regulations related to foodsafety recommendations. In this paper, economics, sociology, legal theory,laws and regulations, food safety analysis, to determine in the regulation offood safety legislation, regulatory bodies and systems, and on this basis,focusing on legal regulation.The first part of the many problems in the field of food safety in Chinain recent years as the starting point of analysis at this stage of research andfood safety legal system of practical significance and research value.The second part of the analysis of the legal status of China’s foodsafety and food safety laws on the legislative and regulatory deficiencies.The third part, analyze and learn from foreign food safety experiencein the legal system and the Enlightenment. Part IV, respectively, from the legislative and regulatory level to elaborate relevant recommendations toimprove China’s food safety laws.The last part, from the legislative and regulatory level on the relevantrecommendations to improve China’s food safety laws.With the improvement of our national economy and people’s livingstandards, food safety requirements are becoming increasingly obvious.Today, countries around the world of common concern with food safetyproblems. Closely related to food safety and survival and development ofhuman society. It can be said that the development of food industry and theimprovement of economic competitiveness depends on the effectiveregulation of food safety issues. Therefore, only update the concept ofgovernance, intensify international cooperation in order to betterco-ordination to address food safety issues of common concern of mankindThe thesis tries to make an study of the problem of China’s foodsafety from the point of view of legal regulation, and makerecommendations for improve legal regulation of food safety. The problem of food safety is very complex,and the resolvents are notonly static legislation and supervision and administration in the wholeprocess,but also the dynamic improving in the legislation and the multiformpattern of supervision and administration.We look forward to the level ofChina’s food safety system attach to the international standards of legalregulation,to shorten the gap with the advanced countries,to improve thestandards of the legal regulation of food safety,to truly protect the health ofresidents,to promote living standards,and To achieve comprehensivedevelopment of economy and society.
