A Survey Report On The Defense Lawyers’ Practice Environment

The criminal defense is one of the important contents in lawyer occupation,and it can reflect the value of the lawyer mostly. In the process of practice,the defense lawyers bear the dual responsibility that is safeguarding the legal rights of parties and maintaining social fairness and justice.Today,in western countries under the rule of law,like The Unites States,defense rate has already reached one hundred percent,but the rate of defense in our country is becoming more and more low.Our defense lawyers is playing an awkward role in criminal proceedings.So,it is necessary for us to examine calmly the defense lawyers’practice environment and to seek for the corresponding solutions.Taking Some Lawyers in the Main City of Chongqing as a Sample,the author did related questionnaire investigations and interviews.In this thesis,the results of questionnaire and interview record has been analysed comprehensively. On the basis of this,the author put forward some suggestions and countermeasures on improving the defense lawyers’ practice environment.This paper is divided into three parts,and it has about nineteen thousand words.The first part is the introduction.It contains five points:research background,research significance,research status,research ideas and material,the innovation and insufficient of this paper.This part elaborates the research methods and ideas of this thesis simply.The second part is the analysis of the survey results. It contains six points:exercising the right of meeting,exercising the right of file review,exercising the right of investigation and evidence collection,the relationship between the defense lawyers and judicial organization staffs,public evaluation for the defense lawyers,the views about the practice environment from those defense lawyers themselves.The third part is the conclusion and proposals.There are four reform proposals in this section:changing the traditional concept and improving the status of the defense lawyers,reforming the system of detention house;carrying out the Law of the People’s Republic of China on Lawyers thoroughly;abolishing the article306th of the criminal law.Improving the practice environment of defense lawyers is a long-term work,it needs all sectors of the community work together.
