The credit card is the cardholder’s certificate, which is issued by the issuing bank in goodstanding in the development of the merchant or agent network billing consumption or withdrawcash from a credit certificate. In the1970s, in the developed market economies, the use ofcredit cards has entered the popular stage. In order to meet the needs of the situation of reformand development, in1979, the Bank of China Guangdong Branch and Bank of East Asia, HongKong signed an agreement to start the agent for foreign credit card business. Thus, the creditcards has entered the Chinese market. After30years of development, the credit cards in Chinahas become an important payment and settlement instruments,but the associated legal issuesbecome more prominent, while the domestic research mostly start from the perspective ofbanks’ risk. This paper attempts to begin the study, from the point of view of consumerprotection in the credit card is mainly discussed the problems faced by the domestic credit cardconsumer protection of personal information, bank information disclosure system and defects,and then combined with the extraterritorial advanced the rule of law experience comparativestudy on this basis to improve our credit card consumers’ rights to protect some of thesuggestions and ideas of the legal system.This text is mainly divided into four sections.The first part analyzes the credit card and credit card consumers and other relatedconcepts defined on the basis of the violation,and then discusses the process of credit cardconsumers face interest on the necessity of the credit card consumer protection.The second part discusses the situation of protection of using credit card. This part isdivided into two aspects of discourse, including lack of sub-legislative level, as well asconsumer privacy, the right to know that actually exist in the current system, and the objectionto right of defense problems facing the two aspects discussed.The third part, the United States and Germany, for example, from the common law andcivil law systems in two modes analysis of the extraterritorial existing advanced the rule of lawexperience, the practical problems in China’s credit card, the dialectical treatment of theinternational face of the credit card related to a series the experience of the legal risk of wheatfrom the chaff, in order to constantly improve our credit card business.The value orientation of the fourth part, clear of credit card consumer protectionlegislation, as the relevant departments of France under the economic regulatory system creditcard, in the improvement process should first clear the nature of the positioning of its economiclaw, and the positioning of credit card consumer protection legislative starting point of thelegislation is to protect vulnerable groups. On this basis, should learn from advancedinternational experience, combined with China’s actual situation of formulate and improverelevant legislation and institutional recommendations.
