Study On Legal System Of Leisure And Pension Industry For Hainnan

The State Council of China, on31December2009, has issued <<pinions on the construction and development for Hainan international tourism Island>>,"(hereinafter referred to as the" Opinions ") which has made a preliminary planning intention on leisure pension industry. This paper attempts to analyze the current situations and existing problems of the pension leisure industry development in Hainan, combined with Hainan of its actual situation, then combined with the pension leisure needs of industrial development in the legal system and its policies from a legal points. China’s current regulations on the development of leisure and pension industry the provisions of the use of economic law theory point of view, the final analysis of the development of leisure pension industry under the background of the island of Hainan International Tourism legal issues, including the following content:Part Ⅰ:On the basis of the legal definition, legislative status quo from the developed countries and China leisure pension industry, to analysis the legal connotations and its relevant characteristics on the leisure pension industry, which has laid a legal foundation for our relevant laws, regulations and normative documents of the introduction to the leisure pension industry of China.Part Ⅱ:At present, there is no specific legislation system in China, just the leisure assets and pension industry laws and regulations and normative documents for pension leisure industry. Therefore, China is lack of legal issues related to the leisure pension industry in macro-thinking, there is no a unified legal policy regulation to development in the pension and leisure industry, from the views of legal policies and systems in domestic leisure industry and pension industry, China should speed up the introduction of relevant laws and regulations for the development of leisure and pension industry, improve the relevant policies, the legal foundation for the development of leisure and pension industry.Part Ⅲ:This paper believes that there must be fully necessity and feasibility of Hainan to the development of leisure pension industry, Which proved from China’s aging trend, and solving the legal problems of aging, strategic positioning and construction of an international tourism island, China’s industrial structure adjustment of its necessity. Also from Hainan which has a unique geographical and climatic environment, the diversity of cultural resources, the unique advantage of special economic zones, rich in leisure and tourism resources, services infrastructure.Part Ⅳ:By introducing Hainan which has been the formation of the current pension leisure industry trend and the legal policy in the pension leisure industry, also combined with the above the legal policy of the domestic leisure pension industry, this paper has analyzed and identified the existing problems of the leisure pension industry of Hainan, and has made a draw on the development of leisure pension on Hainan industries, such as the guiding ideology is not clear, the lock of development planning, incomplete legal system, lack of strength, the lack of industry standards and policy support and other issues.Part V: For the reason of the said described problems in the leisure pension industry of Hainan, this paper points out that the legal advice and policy on the promotion of improvements. Hainan should be re-clear the legal status and the guiding ideas for the pension industry of Hainan, formulating the planning of development, issuing and regulating some relevant local laws or regulations in the pension industry.Trying to issue those preferential policies to support the development of leisure and pension industries that will bring the contribution to the solving of the legal issues in pension industry.The leisure pension industry of Hainan is still in the initial stage, the practice of the process is very short, problems are inevitable, so the thinking and understanding is not clear, the legal system is not perfect, a lot of work putting measures in place, its industrial development and legal regulation theoretical research efforts, little achievements, the research is largely confined to traditional leisure and the current problems of the pension industry and the tourism market services sector regulation, the lack of more in-depth legal research system for leisure pension industry, especially the context of international tourism island of leisure pension industry research and exploration almost no. In this paper, the use of value analysis, comparative analysis, social investigation, describing the study and other research methods combined with the actual construction of the international tourism island, to do our modest means to provide some exposition on the theoretical system, in order to provide the good example to practice.
