Research On The State Secret Of Opening Information By Government

Promulgation and implementation of "Open Regulation of Government Information" has an important significance on the building of democratic and legal government in China. To maintain national security interest, specific information was determined as state secret by the regulation to limit its publicity. So countries classified state secret as one of the reason of limited publicity in the Law of Government Information.Therefore, this paper is based on fundamental rights the right to know, with the clue of unity of opposites of public security, to investigate the exception of Open Government Information and Important theoretical and institutional issues related to state secret. In the part of introduction, this paper explain the purpose, significance, status, trends, scope and methods on the research of state secret of Open Government Information. In the part of theoretical basis, this paper is based on code of our state secret and the theory our state secret of Open Information. I get a Conclusion.state secret of Open Information is to limit fundamental rights the right to know, essentially.This paper is divided into three part.Introduction. Subject and Conclusion. There are four chapters of the subject part. The code of state secret was discussed in Chapter One. At first, I talk about the concept of state secret, secondly I talk about the characteristics of state secret and analyze the range of state secret the secret was known by a certain people at certain time. Chapter two mainly talk about some examples of state secret, the examples are selected from Shanghai located in East China, to analyze the exception of the Open of Government Information in China the problem of state secret exist in Legislation, which is mainly reflected the fuzzy rang of state secret. Chapter three mainly comb the theory of state secret of the Open of Government Information, which advanced reasonable definition the rang of public and private and the necessity of protecting state secret. Chapter four mainly talk about the state secret with the view of reality and theory, advanced the irrationality of the basic rang of state secret. Which is also the part of Countermeasure,raised some suggestion to complete the state secret in our country. At the level of theory, I think we should rebuild a role with the principle of public. At the level of system I think we should build a supporting open state secret systems of "public" and "exception" At the last chapter, I conclude the exception of state secret in our country the complete of system of state secrets.The building of secrecy system can not consider the national security interest simply, at the same time ignore the protecting of the right to know. We should emphasize the importance of maintain secrecy but also pay close attention on the protecting of the right to know.
