The Legal Research On The Copyright Protection Of ACG Characters

ACG (anime、comics and game) industry is a sunrise industry, it is growing vigorously all over the world, and has been being the important aspect of soft power. So the intellectual property of ACG is more and more important. The role of ACG is a supporter of the industry, it is prominent in its literary significance and commercial value with many legal problems as well. However the industry in China is less developed, and the legal research of ACG in the rest of the world is different with each other. So the legal protection on ACG characters of China is still in the first stage. So we should do more research on legal protection of ACG.For this paper, documents research was first used in the initial stage, which can get comprehensive and systematic information and know the legal protection on ACG characters in the past and present. Then defined the connotation and extension, which framed the basic research on legal problems; comparison research help sum up the copyright protection of ACG characters in legislation and judicature; Furthermore, by using the method of case analysis and experience summary, entity and system of infringement on ACG characters has been researching, which structure the protection from the perspective of judicature. The originality of the paper is as follows: First, defining the connotation (such as, personality, etc.) and extension (e.g., image similarity, etc.) for ACG characters; Second, by analyzing the constituent of ACG characters, deconstructing the thought and expression of ACG characters; Third, syllogism in infringement is used for the character to protect the ACG characters to a higher degree(more detailed, more clearly and more systematic); Fourth, summarizing the infringement counterplead of ACG characters, which improves copyright protection of the characters.
