In recent years, merchant ships with armed securities on board began to spring up. As a new business branch of traditional Private Military Companies, PMSC inherit the inherent characteristics of the former, so they have no difference in essence. International treaty Montreux Document regulating traditional PMC, which is not binding and has some omissions, for example, put aside the issue of jurisdiction. Considering the new characteristic of merchant ships with armed securities on board, the present international legal system cannot regulate it effectively, so regulations to the new area are in need urgently.Although the presence of PMSC leads to some new law issues, the industry cannot be banned completely, for it has some positive effects in modern world. The advisable solution is to regulate its behaviors properly, and control the whole industry’s acts in a rational range. It advocates to the shipping and maritime security service industry of our country.This thesis is divided three major parts:introduction, body and conclusion. The body consists of three chapters.Chapter one overviews merchant ships with armed securities on board, on the basis of which, the PMSC, mercenary and PMC are closely discriminated.Chapter two analyses nowadays International legislations and other measures about merchant ships with armed securities on board, and also analyses legal dilemmas we are faced with.Chapter three analyses the lawful issues of merchant ships with armed securities on board, for example, how to carry, manage and use weapons lawfully, who has the ultimate control over force, and also rules of use of force.Based on the above chapters, chapter three analyses the necessity of regulating PMSC of our county, and proposes feasible measures to fix troubles at present.
