With advances in computer technology, network, as a kind of trade changes graduallyinto the People’s Daily lives, the resulting network infringement also poses challenges tothe traditional jurisdiction, shook the region as the foundation traditional jurisdictiontheory. This article from the network infringement cases from the Angle of impact to thetraditional jurisdiction theory, this paper analysis the traditional jurisdiction principles canretain, and insufficient and needs to perfect rules, on the analysis of the internationalrelated theories and rules about network right infringement case jurisdiction, the article isdivided into two lines, one from two outside of the United States and the European Unionfirst network right infringement case jurisdiction practice, proposed to our country networkright infringement case jurisdiction,2from the outside to solve network right infringementcase jurisdiction conflict rules, sums up the opinion of the network right infringement casejurisdiction in our country, on the basis of the above content is put forward to Suggestionsfor network infringement jurisdiction principle in our country, i.e., according to the websiteand server location to determine the jurisdiction of the court, and perfecting the agreementjurisdiction, at the same time, draw lessons from foreign minimum principle andinconvenient court, draw lessons from the court first principle in the pending litigation.
