Since the16th century, self-awareness of human rights originated the concept ofmental patient health protection of human rights, and mechanisms also will continue todevelop, and developed international mental health legislation in Europe and the UnitedStates and the United Nations and relevant international organizations, treaties,declarations and other documents can be demonstrated. But in China, due to the economic,institutional and social dimensions of the health protection of the interests of the mentallyill intensity is lower than the minimum standards established by international conventions,and thus generated a lot of negative impact on the protection of the interests of patient care.To solve a series of problems that exist in the Medical Protection of the Rights andInterests of the mentally ill in China, especially the cause of these problems mayeventually need to return to the mentally ill health equity security system construction, isclosely related to the patient’s medical interest. Reviewing the mentally ill MedicalProtection of the Rights and Interests of the historical process, you can find ties betweenthe mentally ill medical rights protection and human rights development process.Protection of the Rights and Interests of the legitimacy for the mentally ill, you can expandthe argument from the perspective of human dignity, the right to life and health, humanism,order and security, the core of which is to coordinate between the mentally ill medicalinterests with public interests conflict.
