The Analysis On The Problems Of Compensation To The Vehicle Depreciation Loss

With the increment of traffic accident and the improvement of people’s consciousness of rights safeguarding, after the traffic accidents, people have begun to pay attention to not only the compensation to the cost of repairment, but also the vehicle depreciation loss which could also cause lawsuit for the reason that victims sometime request related onus person to pay the compensation to this kind of loss too. However, nowadays there is no clear provision about vehicle depreciation loss in the domestic jurisprudence. Even the professional legal persons have different opinions on problems of how to define and calculate vehicle depreciation loss, whether it should get compensation and so on, not to mention the ordinary people. With the increase of this kind of disputes, vehicle depreciation loss has become one of the issues which need to be solved urgently.This paper consists of the three parts. The first part mainly introduced a case about vehicle depreciation loss, summarized the disputes in it and did preparation for the following analysis. The second part defined vehicle depreciation loss at first. Then the foreign modes of dealing with compensation to the vehicle depreciation loss and some domestic suggestions and opinions are introduced. Finally each dispute was analyzed and solved according to the domestic existing laws. The third part, based on the current situation of treating the vehicle depreciation loss in our country, tried to figure out how to solve the problem of compensation to the vehicle depreciation loss in a better way, from the respects of the cognizance of vehicle depreciation loss, different compensation modes applied to different dipartition of responsibilities, relevant legislative ensurance and insurance.
