This paper has three parts besides the introduction and conclusion.The first chapter describes the merits and major controversy. This chapter is divided into two sections:the first is mainly its case; the second section is the contentious issues of this case.The second chapter is the legal analysis of issues in that case. This chapter is the core chapter of the whole paper, this chapter is divided into four sections:The first section is discuses whether the two perpetrator’s behavior is crime or not, which solution to this problem is the premise to define what kind of crime is; The second is legal analysis whether the perpetrator constitute embezzlement,this section discuses the constitute of embezzlement and the perpetrator’s behavior to expose the reason why the perpetrator does not constitute a crime of embezzlement; The third section is the legal analysis of whether the perpetrator constitute theft, according to analysis the constitution of theft and links between credit card crime and theft to elaborate the reasons for the perpetrator constitutes theft; The fourth section is legal analysis whether the perpetrator constitute credit card fraud. This section is the main part of this chapter divided into two questions:one question is whether machines deceived; another is the perpetrator used the credit card to nature people after picking up.The third chapter discusses the Credit Card Crime Legislation Reference and suggestions. This chapter has two sections:the first deals with aspects of credit card crime abroad legislative reference. This section introduces the legislative situation of credit card crime in United States, Russia, Japan, and Taiwan. The second section gives two suggestions of Credit Card Crime Legislation:first is the definition of credit-card-related offenses and second is the subject of credit card crime.
