History Interpretation Of Administrative Litigation

With the continuous deepening research of legal hermeneutics, legal hermeneuticshas been the specific application tools of department laws.Historical interpretation is abasic method of legal interpretation, and it is worth further discussing the application ofhistorical interpretation in administrative lawsuit.This paper focuses on the relationshipbetween historical interpretation and administrative lawsuit.what is analyzed in thispaper is the possibility of applying historical interpretation to administrative lawsuit andissues of historical interpretation in administrative proceedings by comparing with andlearning from the experience in other legal application of historical interpretation. Thepurpose is to encourage and promote the emphasis on historical interpretation of thecourts and judges in the judicial practice of administrative lawsuit. Comparison and caseanalysis methods are applied in this thesis to make a specific analysis of the meaning ofhistorical interpretation and it’s application. It is inevitable that there are some flaws andinadequacies in this article as the topic studied in this paper is relatively uncommon andthere are few monographs on this topic. By introduction of the historical interpretationin Taiwan and the US, and understanding of historical interpretation, we conclude thathistorical interpretation in the administrative proceedings is of application value andpossible.
