For drivers, drunk driving will arise movement disorders, hyperopia, visual errors, reaction out of control, serious traffic accidents, and bring a loss to people’s lives, property. In February25,2011, the nineteenth meeting of the eleventh NPC Standing Committee voted to add "dangerous driving crime" to the eight PRC Criminal Law Amendment. In May1,2011it was formally implemented."The crime of dangerous driving " is an evident containing subjective crime intent. As long as people do not drive a motor vehicle after drinking, it can be avoided."The original intention of establishment of "the crime of dangerous driving " is to punish subjective driver through the heavy punishment, to eliminate drunk driving behavior, to avoid the traffic accidents, and to create a good traffic environment.After the implementation of " Drunk driving into the punishment " in Zhengzhou, drunk driving acts significantly reduced, and traffic order has markedly improved, and some serious accidents caused by unstable factors has been eliminated." Drunk driving into the punishment" reached some social expectations. However, there are still some unharmonious factors and problems in the implementation.At present, domestic and foreign scholars have conducted the research of " Drunk driving into the punishment" from the perspective of jurisprudence. Almost no one has conducted in the research of implementation problems. Therefore, I try to discuss existing problems, causes and measures of the problems through field investigation, to provide new ideas, methods and suggestions to all levels of the legislature to improve the policies, related rules and regulations of "dangerous driving crime". And provide strong legal support for law enforcement to be more effective according to law against illegal and criminal drunk driving acts, to guarantee people’s security of life and property. |
