The dismissal and the resignation of public servant is the key part of the civil service system. It is also the most important factor in the three essrntial factor of enter,manage,exit.Along with the reform and opening up, several times of the institation reform and civil servants adjustment is in progress in the party and government organs. But the one major drawback of export hysteresis in the civil system which lead to exports sluggish have begun to appear."PRC Civil Servant Law" was promulgated and implemented in2005, the resignation and the dismissal of public servant has promoted to the height of the law. It was determined and implemented gradually as a legal system. It plays a very important role in improving the system of public servants.But in the process of implementation, there are still many weak links which need to be studied and sloved. This paper mainly discusses some problems existing in the exit ways of civil servant and put forward some personal views to solve these problems.First, the paper summarized and stated the theory of the the dismissal and the resignation of public servant system. It provided a theoretial basis for the following. Then in the permise of research which is about the development process and implementation achievements of the the dismissal and the resignation of public servant system, the paper pointed that there are many problems and shortcomings in the the dismissal and the resignation of public servant system and the implementation process. In order to improve and standardize the system of resigntion and dismissal of civil servants in our country, the paper lists the system of resigntion and dismissal of civil servants in many countiries, such as Germany, France, Britain, the United States, Japan and so on,summarizes the experience and sucessful methods of these countries, and promotes many countermeasures:further improve the laws of the system of the resigntion and the dismissal of civil servants;emancipatory thoughts, change ideas,create a good social atmosphere of the resignation and dismissal of civil servants, establish a performance appraisal system and the social security system, establish a scientific transparent employment mechanism.In general, the establishment and development of the dismissal and the resignation of public servant system is the correct behavior, which is consistent with the requirement of the times. Along with the continuing reform and opening up, the dismissal and the resignation of public servant system also develops in the torrent of reform.
