The Study On The Infringements On The Copyright Of Film And Television Programs In The Video Sharing Sites

With the development of the internet and the information revolution, which cored in digital technology, network technology, the total number of Internet subscribers of worldwide has reached to2.4billion till the end of2012. Grounded on web2.0which focuses on the participation, interaction and experiencing of the clients, the internet new media is having a great boom. The video sharing site has been created in2005which has changed the old setup that network users have to passively receive the internet content. Nevertheless, the copyright infringement in video sharing site has been undergone an explosive growth. The copyright issues between the owner of the film and TV works copyright and the infringer have received more concern from both law field and media. The infringement act has brought about many adverse impacts such as a great loss for the copyright owner and the production operator, the burden of compensation and the potential of underpayment to the workers. The remediation over the copyright infringement reflects the management level of intellectual property directly. Sizable economic loss, as well as great damage to the video sharing enterprise will be caused in case those controlling and harnessing measures haven’t been implemented on the issues of copyright infringement.Therefore, there is a great significance in the research and study of video sharing sites infringements.This thesis has been composed of three chapters.The first chapter summarizes the violations of film and television works and the violations of film and television works copyright in the video-sharing site, as well as discusses the nature of the infringements of the copyright, the emergence of copyright infringements, the definition of copyright infringemenst, elements of the responsibility.The second chapter specifically analyzes the causes of the violations of film and television works’ copyright in the video-sharing site, thus reveals the causes of the violations of copyright in the video-sharing site from legal point of view, economic point of view, and technical point of view.The third chapter studies the countermeasures and advisement to the violations of film and television work copyright in the video-sharing site. Find the measures and advisements from the aspect of improvement of legislation, enforcement of administrative protection of the government and the conscious of copyright protection and discusses the introduction of collective copyright protection system.Based on both the communication theory and laws, this thesis has given a clear definition to the video sharing sites infringements, under which the characteristics of those video sharing sites, the constitutive elements, definition, together with the cause and the present situation of the video sharing sites infringements has been analyzed and studied. Meanwhile, this thesis attempts to put forward a classification for the reasons of copy right infringements of the video sharing sites from the aspects of legislation, economy and techniques. At last, this thesis gives a conclusion and further suggestions to the control measures over the copyright infringements.
