Analysis On Problems Of Freight Forwarder Concerning Delivery Documents

As the designer and organizer of international goods transportation, freight forwarders perform their duties as significant bridges between international goods transportations by sea and imports/exports trade. Whether or not freight forwarder can deliver documents properly has great influence on whether or not international trade can proceed smoothly. Thus, considering Article7, Article8and Article10of the newly enacted the Provisions on a Certain Number of Problems concerning the Trial of Cases Related to Sea Freight Forwarding (hereinafter referred to as "the Provisions "), this thesis studied the problems of documents delivery by freight forwarder thoroughly.The author discussed this topic through the following five parts:Part one mainly introduced the concept of international freight forwarder and the connotation of international trade documents, and indicated main points of dispute about documents delivery by freight forwarder.Part two analyzed rights of documents detention of freight forwarder’s, and discussed whether or not the freight forwarder had obligation to deliver documents and whether or not the freight forwarder enjoyed rights to refuse documents delivery.Part three, by considering background and details of Article8of the Provisions, particularly analyzed documents delivery by freight forwarders under FOB terms.Part four analyzed the legal liability of freight forwarder violating obigation of documents delivery by comparing Contract Law with the Provisions.Part five proposed recommendations on how freight forwarder to perform obligation of documents delivery properly.
