The Research Of The High Altitude Parabolic Tort Civil Liability

In recent years, there are more and more high altitude parabolic infringement cases, with very serious consequences, and bad social influence. Although academic circles in China have been made an thorough analysis and research to this kind of special infringement behavior, but there are still a lot of blank and legislative defects, this has brought the social public confusion and controversy. Although the new "Tort Liability Law" to some extent, filled the gap, and provides a more clear direction to deal with such cases of infringement in judicial practice, but there are still many problems which we need to make a further discuss. This article introduces the high altitude parabolic infringement civil liability in systematic research, hopes to make my own contributions for our country’s tort law.This article mainly divides into five parts:The first part mainly introduces two specific case of high altitude parabolic infringement cases, and briefly analysis on the legal issues, the main purpose is to direct the high altitude parabolic infringement civil liability theory.The second part mainly introduces the definition of high altitude parabolic tort, including high altitude parabolic the concept, constitutive requirements and characteristics of infringement behavior, and related infringement behavior, its difference with related tort.The main purpose is to lay a theoretical foundation to the research in the following.The third part mainly introduces the high altitude parabolic tort responsibility, including the tort imputation principle, the determination of responsibility main body, the responsibility and justifications, in order to make a further inquiry for high altitude parabolic tort civil liabilityThe forth part mainly put forward suggestions about how to improve current law modified in China, in order to provide legal support for the law has a sufficient, then establish the authority of the law. At the same time, through the establishment of multi-level compensation or compensation system, make a reasonable balance between freedom, civil rights protection and behavior, and safeguard social public’s interests fundamentally.
