Research On The System Of Disclosure Of Origin Of Genetic Resources

Genetic resources relates to the common interests of mankind closely, it has veryimportant value as one part of the biological diversity. Genetic resources is not evenlydistributed, developing countries are rich in it, but they are incapable to use it due to lackof advanced biotechnology; on the contrary, the developed countries owning advancedbiotechnology, are capable of producing new products with genetic resources, however,they are lack of genetic resources. Faced with such embarrassing situation, and in order tofully take advantage of genetic resources，bring into play its greatest value，developing anddeveloped countries was reached a compromise, proposed benefit-sharing. To ensure therealization of the purpose of benefit-sharing, the system of disclosure of origin wasproduced. As one of the developing countries, China has a significant number of geneticresources, and the biological research capacity ranks the first among developing countries,therefore we should build the system of disclosure of origin focus on the specific situationof China in the patent law, narrow the range of the concept of genetic resources, submit theevidence of prior informed consent and benefit-sharing, clear relevant legal consequencesin undisclosed and false disclosure.
