Kirgiz nation that this paper investigated, to inhabit region as the reference system,mainly refers to the residents living in Xinjiang Kirgiz Kizilsu Kirgiz Autonomous Prefectureand scattered in Xinjiang Urumqi city. Since the “Marriage Law of the People’s Republic ofChina” and “The Inheritance Law of the People’s Republic of China” are issued andimplemented, good effects have been made in Kirgiz areas. But some conflicts still existbetween the marriage customs of Kirgiz and the marriage law of our country. Therefore,studying the conflict phenomenon and looking for the countermeasures especially significant,this is also the purpose of this paper.This paper is divided into six parts, the first part is the introduction;the second partexplains the relationship between ethnic custom and state law;the third part introduces themain marriage custom of Xinjiang Kirgiz existing; the fourth part discusses the conflictsbetween the Kirgiz marriage custom and national marriage law and the causes and consequences; Thefifth part discusses the specific theories and rules of the Kirgiz marriage custom and nationalmarriage law conflict with, and put forward to the adjusting measures on the two party; thesixth part is a conclusion, makes a summary to the full paper.The Significance of this paper is through the adjusting measures of the conflicts betweenthe Kirgiz’s marriage custom and national marriage law, first can steadily resolve the conflictbetween Kirgiz’s marriage custom and national marriage law; second can further optimizeChina’s domestic legislation and judicial reform and provide strong theory support andpractical way for the reformation and inheritance of the Kirgiz’s marriage custom; third canoffer some references for the conflict problem solving of conflicts between the Kirgiz’smarriage custom and national marriage law in other national autonomous regions...
