Identification And Bearing Of Responsibilities Of The Un-internuncial Joint Torts

It has been argued hotly about how to identify the un-internuncial joint torts andhow to be responsible for it, meanwhile, the justice practice are varied. Although the“Tort Liability Law of the People’s Republic of China” has came into force on Jul.1st,2010, the argument dose not stop about the theoretical and practical problems of theun-internuncial joint torts. So, it is aim of this paper is that how to identify theun-internuncial joint torts and ascertain the liability legitimately.In the first part of the paper discusses the identification of the un-internuncialjoint torts, it includes the analysis of the concept, property and constitutiverequirements. In the second part, it studies the relative institutions of theun-internuncial joint torts at home and abroad, and analyses the advantage anddisadvantage. In the third part, there is a detailed description of the accountabilitymethods of the un-internuncial joint torts.The un-internuncial joint torts is that two or more tortfeasors caused a kind ofdamage to the victim without subjective connection by chance. With respect to theresponsibility, the viewpoint of the paper is that: the tortfeasors take joint liabilities ifthe injury is separable, and the tortfeasors take joint liabilities if the injury isinseparable.
