The recruitment of civil servants in China has been recorded under the background of profound social transformation and development. In recent years, on the one hand, the work of recruitment have accumulated a wealth of experience and innovative effective approaches; on the other hand, a number of problems also has been exposed in different regions, which needs to be studied and solved. Among these problems, there is more focus on issues of the post qualification of civil servants’ recruitment both in the system and practice levels, but related research in China is relatively weak. Standard position qualifications sets are basic requirements of equity in civil servant’s recruitment, are important components of perfecting the system of civil servants’ recruitment in China, as well as promotion of administration by law and constructing legal Government and inner meaning of building a harmonious society. Therefore, study of position qualifications sets have yet to be deepening.According to the academic communication and the provisions of the law on civil servants, civil service examination admission qualifications are divided into positive, negative qualification and post qualification. At present our civil servants’ post qualification set has three basic requirements:First, post qualification should be set at or above the provincial level by civil service departments; Second, the qualification conditions designated for a specific position must be necessary; Again, the contents of the prescribed requirements shall not violate the law, and cannot conflict with positive and negative qualifications that the civil servant law regulated. In terms of the legal nature of civil service examination admission qualifications, in current academic circles there’re theories such as public authority, right of examination, and equality and so on, these theories are mostly use protection of citizens basic rights as the starting point, pay more attention to the basis and the principle of post qualification sets, and concerned less about the feasibility of the specific operation level. The author thinks that, to normalize the sets of qualifications, especially post specifications, we can regulate the administrative behavior.Now that the current problems in China’s qualification set of civil servant’s recruitment recorded mainly for:first, there’s no normative basis of post qualifications. Until now, the Central Government authorities haven’t got a unified guiding directory as a set of professional qualifications on the basis of professional classification, while local civil servants in the province lack of competent authority for professional qualifications sets based on three main approaches:developing professional classification Guide Directory in the province; a simple reference to the Ministry of education professional categories; directly avoided. These three approaches have different operational problems, and lead the inconsistencies of professional restrictions to the same candidates in different provinces, which affect the equitable. Second, the proportion of restrictions is too restrictive and unreasonable. Current laws and regulations leave larger space for post qualification sets, although we can develop post qualifications according to the actual situation, but also lead to some post qualifications set’s limit, cannot meet the higher education needs of the new situation and new development of the civil service examination. Third, the post qualification sets program are incomplete, first of all, lack of scientific proof, and broad participation in the process; secondly, the qualification sets review process are not clear; again, lack of remedy after the publication of qualifications to apply for.Under the big background that the administrative law system in our country is necessary to be reformed, the legislation about civil service examinations qualification details still needs time to be perfect. Normalization of post qualification settings should follow the principle of law, administrative authorities to substantially specific behavior provides the legal framework at the same time, also for the future detailed theoretical basis for the establishment of the rule of law. The author thinks that, position qualification sets shall be mainly under the principles of proportionality, improper connection retention ban principle, equality principle and the law. Extraterritorial civil servants and starting system also offers a reference way for our country:first, public, stable and easy to qualification sets; second, by the grading examination system of civil service classification; again, the perfect post qualifications set laws and regulations.Post qualification set of civil servants’ recruitment through examination in our country can be normalized step by step with the following practical path. First of all, establish classified post qualification set concept and way of setting. The provincial civil service department local government regulations or local government regulations in the form of the following normative documents, unified clearly defined at all levels of posts in the set standards and principles. The integrated management of class position and administrative law enforcement class qualification sets should be relatively broad, especially in the area of restriction and degree qualifications for professional qualifications should not be too strict; the qualifications set of professional and technical class positions can be appropriately strict; primary positions and decision-making, investigative positions should be applied to different qualifications set standards; for qualifications that may involve basic human rights such as age, gender, etc., should be as broad as possible. Second, improve the post qualifications set program. Mainly start from the following aspects to ensure that the post qualifications set of standardized, scientific and legal system: to strengthen the awareness of administration according to law, improve the position description system, strengthen the use of the hearing system, improve the relief system. Again, improve the employment system and special position recruitment system pilot.
