With the reform of the economic system moving through, the benefit of each class inthe society has been differentiated and reconstructed seriously. In labor law area, thisphenomenon can be found in the benefit confliction between labor and capital. Employeesare at the disadvantageous point when they face to the employers, even though, ourgovernment has established a serious of relative laws and rules, they are still not perfect.There are many blanks and paradoxes in the area of labors’ dismissal protection. Wealways institute the Inclined Protection Principle. However, the employers, they are themajority party of the investigating market. This situation make us should take care of thebalance of protecting the labors’ legal rights and maintaining the activity of the employers.In the practice, the cause of discharge is the most important in the dismissal protection andseparation management. The shortage and unidentified elements of cause of discharge willmake the whole parties feel confused during setting the disputation. So, we should focus onthe area of the cause of discharge, developing the theory and protecting the labors’ legalright well.
