We have a right to speak something about TCM. However, with the development of economy and the strength of internationalization, foreign developed countries make TCM which belongs to us of their selves though the patent protection with their perfect legal system. It brings huge loss to us. The TCM enterprise is the main body of patent protection in TCM. It is a hot topic about how to use the patent protection to protect TCM. There are many benefits to strengthen the patent protection of TCM enterprises. On the one hand, it can stimulate the innovation of enterprises. Enterprises can research and develop products with independent intellectual property rights and achieve the goal of their economics in this way. One the other hand, it can improve the international competitiveness of the TCM enterprises and improve the international position of our country. Therefore, it has an important significance to strengthen the patent protection of TCM enterprises.The article mainly stands in the position of enterprise which makes the full study of the patent protection in TCM though the domestic and foreign related literature analysis and combined with the situation of our country.
