In recent years, private equity funds is regarded as a new thing which graduallyintegrates into China’s economic life from United States.In China’s financial market，there are many investment channels and investment diversification means.As a kindof very effective means of investment, private equity funds has brought opportunitiesand challenges for the development of China’s economy. In the background offinancial crisis, how to guard against financial risk？What is the reasonable regulationand regulation？That’s a common huge problems which happened all around theworld.This essay will try to set up a new method of evaluating the necessity of theregulation of the Private investment funds through the view of Economics, thenhighlight the limitation of the strategy of legislative process and come up with somerationalization proposals for it. This method have theoretical and practicalsignificance on maintaining financial stability, reducing financial risks, attractinginternational capital and achieving the effective and rapid development of privateinvestment funds in China.This paper adopts the method of combining normative analysis and empiricalanalysis.Combining with China’s national conditions and the actual situation of thecurrent development of China’s private equity fund, it presents opinions on legalregulation for private equity fund. On the basis of analysis in economics, we foundthat the most suitable way of legal regulation method，which conforms to China’scapital market development trend is that，accelerate the process of private equity fundlegislation.At the same time guarantee in respect of laws and regulations andstandardize private funds supporting system up and running. Finally to the conclusion,I puts forward my own opinions and hope it would be meaningful for the regulation ofprivate equity fund of our country.
