On Expropriation Compensation Justice

China is a large agricultural country. The problem of agriculture, rural area andfarmer is vital to the development of Communist Party of China (CPC) and thecountry as well. Nothing is trivial related to the issue of agriculture, rural areas andfarmers. Along with the deepening of reform-and-opening-up policy, and speedingurbanization, more and more rural land is being expropriated. Hence an increasingnumber of social disputes results from the problems in land expropriationcompensation. Fair and just resolutions to disputes arising from land expropriation areof great significance. It is not only beneficial to the rational utilization of landresources, but also to the justice in land expropriation compensation. It is so as tosafeguard the lawful rights and interests of farmers and achieve the goal in thepeople-oriented administration.At present, the increasing of “nail households” and mass incidents，whichtriggered by the land expropriation, calls for a radical reform to the compensationsystem. This paper, starting with the present situation and causes of the expropriationcompensation justice deficiency, tries to find out the ways and methods to ensureexpropriation compensation justice. Finding out the crux, seeking the ways out, so asto achieve expropriation compensation justice and create a harmonious socialenvironment.The thesis consists of four parts.Part one discusses expropriation compensation justice and its necessity. Byclarifying the connotation of expropriation compensation justice, studying thesituation of expropriation compensation justice, and analyzing the necessity ofexpropriation compensation justice, this part is intended to provide a theoreticalfoundation for the thesis.Part two points out the basis, principle and content of expropriationcompensation justice. Part three studies the moral hazard and its prevention in expropriationcompensation. By studying the connotation，manifestation, causes and effect ofexpropriation compensation justice, drawing experience and lessons from preventionof moral hazard in expropriation compensation, introducing foreign experience ofrealizing expropriation compensation justice, this part tries to discover the methods toprevent moral hazard, and put forward practical measures.Part four explores the way and method to achieve expropriation compensationjustice. By analyzing the necessity of institutional, procedural and outcome justice,and by discussing ways to improve, this part puts forward the effective method toguarantee expropriation compensation justice.
