In the process of establishing and improving the socialist market economy,administrative monopoly has drawn widespread attention from all sectors ofsociety especially in China. We passed “antimonopoly law” in1998whichpayed more attention to economic monopoly than administrative monopoly, sothe theoretical study of this issue has a lot of room for improvement. Inaddition, the concept and the definition of administrative monopoly have notbeen given a full explanation so that there are more and more negative caseshappened. It is very apparent that we need a feasible way to put moreresponsibility onto the governments whose actions make into administrativemonopoly. What is the most important is how to use the terms aboutadministrative monopoly in the law rather than “making new laws”, we thinkpunitive compensation could resolve this difficult question bases on someregulations and legal precedents in other countries. By the way, there are manysimiles between administrative monopoly and civil tort, what we need to do iscontrol the standard of the punishment and the scope of our “antimonopolylaw”.
