This thesis is divided into four parts regarding crime of holding counterfeitinvoice with28thousand words.The first part discusses the definition of the crime as well as its characteristicsand value. The definition of the crimes refers to selling or buying counterfeit invoicewith huge amount which is becoming diversified due to its complicated characteristics.Therefore, it’s necessary and critical to improve related laws and systems to guaranteesocial justice.The second part analyzes key components of the crime. This crime refers toinvoice including ordinary invoice and special invoice. The counterfeit invoice can beclassified into tangible invoice and intangible invoice according to its legal procedureand its content. The objective perspective of the crime is of illegal features. Based ondifferent criteria, there are two types of holding counterfeit invoice which are directholding and indirect holding, separate holding and joint holding, single holding andcomplex holding.The third part mainly deals with unfinished form and plural crimes of holdingcounterfeit invoice. In this crime, there are preparation for a crime, attempted crimeand interruption of it with its later two existing during preparation period. In reality, ifholding counterfeit invoice is investigated and then it’s defined as the crime ofholding counterfeit invoice. In legislative practice, judicial authority should payattention to many time holding, stop holding and illegal use of invoice.The fourth part is about the standard of large amount and huge amount. Theauthor believes that this crime is of no limitation of prosecution. Large amount refers to holding200invoice with its total800,000while Huge amount refers to holding2,500invoice with its total10,000,000.
