The Tiansheng laws of Xixia code is an existing fairly completecomprehensive code of mediaeval times which sets the rule on theft strictlyand detailedly. It adjusts the content in line with the national reality and basedon the reference to the Central Plains Code. This paper focus on theexploration of the lawmaking of larceny in Tiansheng laws to introduce thesubject, object, main trail principle and special trail method, etc.. At last, theauthor consider each part under the background of the Chinese Legal Systemand the overall social situation, to explore the social reality reflected fromspecific laws and seek the legislation base in historical documents. The keyargument is to compare larceny in Tiansheng laws with that of laws incotemporaneous Zhongyuan Dynasty concerning the phenomena and causesof the less serious sentence and large amount of doctrine of analogy.
