With the deepening of China’s reform and opening up, economic and social sustainabledevelopment and other undertakings, the incidence of minor injury cases increased year byyear, has become one of the factors influencing social harmony and stability. China’s currentmechanism of handling such cases has some inconsistencies. In judicial practice, the filing,control and handle of the People’s Court, People’s Procuratorate, the public security organs ofthe cases of intentional injury (slight) have many problems and contradictions, thus affectingthe credibility of the judiciary and directly affect the social order, stability and harmonioussociety. It is necessary to make a review of the traditional mechanisms of injury litigation, andto remodel light injury litigation, in compliance with procedural rules, in order to reduce thetraditional disadvantages of the mechanism to protect the legal rights of victims andeffectively to resolve social conflicts.This study talks about the mechanism of action of light damage, from abroad such as theUnited States, France, Japan and other developed countries. Combining with the status quo ofChina’s judicial practice, the thesis analyzes the existing problems on the legislation andjudicial practice in cases of light injuries. And advances some countermeasures andsuggestions to improve our light damage litigation mechanism, including all cases of lightinjuries are classified as the prosecution’s case, classify standard of filing, the introduction ofthe principle of the criminal settlement, and further refinement of public security agencies indealing with cases of light injuries should be applicable to specific procedures. Through thisimprovement measures, the author hopes that to better handle cases of light injuries, maintainsocial stability and harmony.
