On The Legal System Of Foreign Equity Acquisition In China

With the acceleration of economic globalization and the deepening and adjustment of China’s reform and opening up, foreign investment is becoming an important force in promoting China’s economic development, and foreign equity acquisition has also become the main way of foreign investment in China.Foreign equity acquisition’s impact on China’s economy is like the two sides of a coin. On the one hand, it not only improves the competitiveness of enterprises, but also promotes China’s economic development. On the other hand, it also has a negative effect such as monopoly. What’s more, lacking uniformity, scientificity and operability, China’s legal system of foreign equity acquisition is not perfect. In view of the fact that the current foreign equity status does not fit in with the current legal framework, it is importantly significant, practically and theoretically, for the research and exploration on the legal system of foreign equity acquisition in China.Firstly, this dissertation begins with the basics of foreign equity acquisition and through a comparative analysis, tracing the origin and cause and other methods, it reveals the nature and connotation of foreign equity acquisition. Then, it simply analyzes the problems of the legal system in terms of the legislative process and the application of law in general. Then, it focuses on the specific problems confronted during foreign equity acquisition such as foreign capital admittance, national security review, anti-monopoly. It explains the author’s idea in detail. Finally, on the basis of summarizing the legal system defects, it puts forward the specific methods to improve the legal framework.
