Preliminary Analysis On The System Of Drugs Control In The Early Years Of New China In Chongqing Region(1950-1952)

In the early days of China, the prevalence of the opium problem had jeopardized thepeople’s living standard, social stability and the consolidation of political power to a largeextent. In order to counter the opium problem, all levels of governments promulgatednon-smoking and anti-drug laws, and launched a vigorous anti-drug campaign, all of whichachieved a great success in the end. At that time, Chongqing, as the location of the executiveauthorities of southwest China, was also the main drug distribution center of southwestregions in the early days. Through the powerful implementation of the smoking laws andregulations promulgated by the Central Government and the southwest China, the opiumproblem in Chongqing region was eradicated in within three years.This thesis is made up of four parts, including introduction, body, references and thanks.In this thesis, we mainly study about the anti-drug law and the implementations in the earlydays of Chongqing (1950-1952), which is divided into four parts as follows:In the first section, the historical background of anti-drug campaign in the early days ofChongqing is described from two aspects: the historic environment and drug status. Wedescribed the importance of the Chongqing’s location in the early days, the complex domesticand international environment, the unfavorable legal environment for the construction of thelegal system, as well as the prevalence of drug problem in Chongqing area.In the second section, we analyze the anti-drug legislation in the early days ofChongqing. As the capital of the southwest China, Chongqing developed only a few her ownanti-drug legislation, Instead, she strictly implemented the laws from Central Government,and taken the drug laws of the southwest region as the implementation basis. Therefore, it isnot reasonable to study the Chongqing’s anti-drug legislation without the analysis of anti-druglegislation from the Central Government and southwest China. The second section will focuson the origin and content of the anti-drug legislation, and also the implementation result inChongqing.In the third section, we analyze the judicial status of the anti-drug laws in Chongqingbased on Chongqing’s archives and local history. Firstly, we introduce the procuratorialsystem and the provisions of the justice system in the early days of Chongqing, as well as theinstances in the anti-drug trial at that time. Secondly, we study the opium crime situation from the criminal point of view. Finally, we show the status of the anti-drug legislation in thejudgment system of Chongqing through the analysis of the sentencing to the drug dealers.In the fourth section, the evaluation of anti-drug legal system is discussed. On the onehand, we evaluate the historical and practical significance of the anti-drug legal system in theearly days of Chongqing. On the other hand, we point out the deficiencies of the anti-druglegal system in Chongqing, and rethink the national policy and program in the anti-drug legalsystem.
