Research On Electronic Data

At present, in China’s judicial practice, although the electronic data has played an increasingly important role, but the legal requirements for electronic data is not specific enough. The definition of electronic data collection and review of the judgment to the lack of effective legal norms the status quo, the Police and Justice in the handling of criminal cases related to computer and network at a loss. The huge gap between the needs of the judicial practice and legal requirements blank, making the concept of features of the electronic data, electronic evidence collection and review of the judgment on specific issues to discuss with the theoretical value and practical significance. In this paper, three parts in all explore issues related to electronic data in criminal proceedings.The connotation and extension of the first part focuses on electronic data. This section proceed from the concept and characteristics of electronic data, electronic data to make a specific definition. On the problem of the legal status of electronic data, it has admitted to evidence of ability, and given the status of independent.The second part focuses on the problem of evidence in electronic data collection.
